The aftermath of a motorcycle accident can be overwhelming.
From severe injuries to mounting medical bills and lost wages, the road to recovery is often challenging and filled with obstacles that most victims aren’t prepared to face alone.
To add to this already difficult situation, while you’re focusing on recovery from potentially very serious injuries, insurance companies are working strategically and aggressively to reduce their liability (and their payouts to you).
Every day, countless motorcycle accident victims across Phoenix are taken advantage of by insurance companies looking to minimize payouts and maximize profits.
Many Phoenix motorcycle accident victims don’t realize that insurance companies routinely undervalue claims, hoping victims will accept quick settlements out of financial necessity.
The reality is stark: accident victims without legal representation typically receive settlements that are, on average, 350% lower than those with experienced attorneys who know how to maximize settlements (according to a study done by The Insurance Research Council).
The consequences of accepting an inadequate settlement can be devastating:
All as a result of a motorcycle accident you were not at fault for!
Motorcyclists lack the protective shell of a car, making them particularly vulnerable to severe injuries.
This vulnerability often leads to insurance companies and opposing parties attempting to minimize claims or shift blame onto the rider.
Many motorcyclists in Phoenix face an uphill battle when seeking compensation after an accident.
Insurance adjusters may employ tactics designed to reduce your settlement or deny your claim altogether.
Without proper legal representation, you risk receiving far less than what your injuries and damages truly warrant.
The physical, emotional, and financial toll of a motorcycle accident can be devastating. Severe injuries often require extensive medical treatment, rehabilitation, and time away from work.
When these accidents occur due to another party’s negligence, you deserve compensation that fully addresses your losses.
Motorcycle accidents often result in severe injuries that require extensive medical treatment and rehabilitation. These injuries can have life-altering consequences, including:
Even with a helmet, motorcyclists can suffer traumatic brain injuries that may lead to cognitive impairment, memory loss, personality changes, and other serious neurological issues. These injuries occur when the brain collides with the inside of the skull during impact.
TBIs range from mild concussions to severe injuries causing permanent disability. Victims may experience:
Recovery often requires specialized neurological care, cognitive rehabilitation therapy, and ongoing medical monitoring. Many TBI victims never fully recover and require lifetime assistance.
Damage to the spinal cord can result in partial or complete paralysis, requiring lifelong medical care and assistance with daily activities. The location of the injury on the spine determines the extent of paralysis:
Beyond paralysis, spinal cord injury victims often experience:
These injuries transform every aspect of a victim’s life, requiring home modifications, specialized equipment, and often full-time caregivers.
When a rider is thrown from their motorcycle and slides across the pavement, the resulting abrasions can cause severe scarring, nerve damage, and infection risk. Despite its relatively mild sounding name, road rash can lead to permanent disfigurement and disability.
Road rash is categorized by severity:
Severe road rash complications include:
Treatment often involves painful debridement procedures to remove embedded road debris, skin grafts, and long-term wound care with significant risk of complications.
Multiple broken bones often require surgical intervention, extensive physical therapy, and may result in chronic pain or permanent disability. Motorcycle accidents frequently cause:
Orthopedic injuries often require:
Many victims develop post-traumatic arthritis and ongoing complications that permanently limit mobility and increase lifetime healthcare needs.
The impact of a collision can cause internal bleeding and organ damage that may not be immediately apparent but can be life-threatening if not promptly treated. These hidden injuries include:
These injuries often require emergency surgery, intensive care treatment, and can lead to permanent organ dysfunction. Complications may not fully manifest until days or weeks after the accident, making immediate and thorough medical evaluation critical.
When motorcyclists are pinned between vehicles or objects, they may suffer crush injuries that can lead to amputation of limbs. These catastrophic injuries involve:
Amputations may occur at the accident scene or be performed surgically when limbs cannot be saved. Victims face:
These life-altering injuries necessitate not only immediate medical intervention but ongoing specialized care, prosthetic technology, and substantial lifestyle adaptations.
The cost of treating serious motorcycle accident injuries can be overwhelming:
Recovery doesn’t end at hospital discharge. Most serious motorcycle injuries require:
Many victims require significant modifications to continue living independently, including:
The financial impact extends beyond medical bills:
This all can add up to hundreds of thousands if not millions of dollars over the course of years or decades.
It’s not just about getting as much money as possible for the sake of it. Recovery and the after-effects are often far more costly than people realize.
If you don’t get properly compensated now, you will be the one paying for all this.
Insurance companies understand these astronomical costs and will work aggressively to minimize their payouts.
The truth is that they don’t care about you or how much pain and suffering you go through.
They care about their profits.
And they will fight for them and take advantage of you if they can.
Here are the common challenges motorcycle accident victims face when trying to seek compensation for their injuries:
Many at-fault drivers carry only minimum liability insurance ($25,000 per person in Arizona), which is often no where near enough to cover serious motorcycle injuries. When the at-fault driver’s insurance falls short, you may need to pursue additional sources of compensation, such as your own underinsured motorist coverage.
Insurers and juries often hold prejudices against motorcyclists, wrongly assuming they are reckless or risk-taking. These biases can unfairly affect liability determinations and settlement offers.
Motorcycle accidents typically result in catastrophic injuries like traumatic brain injuries, spinal cord damage, and multiple fractures. These high-value claims face aggressive resistance from insurance companies trying to minimize payouts.
Without clear evidence, determining fault becomes complicated. Insurance companies may claim you were lane-splitting, speeding, or otherwise contributed to the accident to reduce their liability. You will need to prove otherwise.
Insurance companies often try to attribute injuries to pre-existing conditions rather than the accident itself, significantly reducing your potential compensation.
Some serious injuries, particularly traumatic brain injuries, may not manifest immediately. Without proper documentation connecting these injuries to your accident, insurers may deny coverage and leave you to foot the bill further down the road when the symptoms do show.
Insurance companies often try to pressure you to accept quick, undervalued settlements before you understand the full extent of your injuries, particularly when you face mounting medical bills and lost income, in order to reduce their costs.
At Farar & Lewis LLP, we’ve seen too many motorcycle accident victims accept settlements that seemed generous initially but proved woefully inadequate as medical bills continued and complications developed.
Our experienced attorneys understand exactly how to calculate the true lifetime cost of serious injuries and fight for compensation that provides genuine financial security for your future.
Don’t risk facing these overwhelming costs alone. We will help you to:
With skilled legal representation, you’ll receive settlements that account for both current and future medical needs. Our attorneys work with medical experts to project lifetime care costs, ensuring you have financial security for ongoing treatments, future surgeries, and potential complications.
Our experienced legal team ensures your case settles only when the full extent of your injuries and long-term prognosis is clear. We prevent premature settlements by managing communication with insurance companies and advising you on reaching maximum medical improvement before finalizing any agreements.
We conduct thorough investigations to uncover all potential sources of compensation beyond the at-fault driver. This includes claims against vehicle manufacturers for defective components, government entities responsible for hazardous road conditions, or businesses that may share liability in your accident.
Our attorneys have the specialized knowledge to accurately document and maximize non-economic damages like pain and suffering. We build compelling evidence of how your injuries have impacted your quality of life, often securing compensation that substantially exceeds medical costs alone.
With Farar & Lewis LLP guiding your case, you’ll avoid critical mistakes that could undermine your claim. We manage all deadlines, handle all communications with insurers, advise you on social media usage, and ensure every aspect of your case is handled with precision to protect your right to maximum compensation.
At Farar & Lewis LLP, we represent clients in all types of motorcycle accident cases, including:
Even if no other vehicle was directly involved, you may have a claim against a government entity for road defects, a vehicle manufacturer for defective parts, or other parties.
Complex accidents involving multiple vehicles require careful investigation to determine liability among several parties.
When the at-fault driver flees the scene, we work to identify them through investigation and also explore uninsured motorist coverage and other avenues for your compensation.
Accidents caused by drunk drivers often warrant additional punitive damages. We aggressively pursue maximum compensation from intoxicated drivers who cause serious injuries.
With the rise of cell phone use behind the wheel, distracted driving accidents have increased dramatically. We gather evidence of distraction to strengthen your claim against negligent drivers.
Crashes involving commercial vehicles like trucks or company cars may involve additional insurance policies and corporate liability. We identify all possible sources of compensation in these complex cases.
For families who have lost loved ones in fatal motorcycle accidents, we provide compassionate representation to secure compensation for funeral expenses, lost financial support, and the emotional impact of your loss.
The actions you take immediately following a motorcycle accident can significantly impact your ability to recover compensation. Our attorneys advise on critical first steps, including proper medical documentation, evidence preservation, and avoiding damaging statements to insurance companies.
Our legal team conducts a thorough investigation, collecting police reports, witness statements, surveillance footage, and other critical evidence before it disappears. We also work with accident reconstruction experts when necessary to establish clear liability.
We help coordinate appropriate medical care and ensure all injuries are properly documented. This includes connecting clients with specialists who understand how to correctly document injuries for legal purposes as well as providing effective treatment. This will aid in increasing your compensation amount.
Our attorneys calculate the full extent of your damages, including current and future medical expenses, lost income, property damage, pain and suffering, and other impacts. We frequently work with medical and economic experts to accurately project long-term costs which impact your settlement amount.
Armed with comprehensive evidence and damage calculations, we engage in strategic negotiations with insurance companies. Our reputation as effective litigators often results in higher settlement offers without the need for trial.
If insurers refuse to offer fair compensation, we are fully prepared to take your case to court. Our trial attorneys have extensive experience presenting compelling motorcycle accident injury cases to Arizona juries, resulting in fair settlements for our clients.

The Plaintiff, a commercial trucker, was violently struck by another commercial truck that ran a red light while travelling at a high rate of speed. The Plaintiff was hospitalized for over a month and sustained multiple orthopedic injuries some of which required surgery. The Plaintiff’s medical bills totaled approximately $140,000.00. The Defendant’s insurance company originally only valued the Plaintiff’s case at a few hundred thousand dollars. After a tough litigation, Farar & Lewis was able to recover the Defendant’s policy limits of $1,516,530.18 (*The Defendant was a Canadian trucking company with a policy limit of $2,000,000.00 Canadian Dollars).
Our client’s vehicle was rear-ended. Following the accident, our client developed neck and back pain. After failed conservative treatment, she underwent cervical artificial disk replacement surgery. While the surgery was successful alleviating most of her accident-related pain, she did develop a mild form of a pain disorder called Complex Regional Pain Syndrome. In spite of our client’s serious injuries, the Defendant’s insurance company refused to make any settlement offers arguing that the accident was too minor to cause any of our client’s injuries. After a contentious litigation and shortly before trial , Farar & Lewis, LLP was able to obtain the Defendant’s insurance policy limits of $1 million for our client.
Our client was riding his bike to work when he was struck by a truck. As a result of the accident, our client sustained a serious shoulder injury which required surgery. While our client did lose some of his range of motion in his non-dominant arm, he was able to go back to work and return to most of his daily activities. At mediation, the Defendant’s insurance refused to offer any money over $500,000.00 as they felt this compensation was more than fair for our client. Farar & Lewis, LLP did not agree and moved forward in preparation for trial. Only a couple months later, Farar & Lewis, LLP was able to get our client $1.2 million in compensation.

You may be entitled to economic damages (medical expenses, lost wages, property damage, rehabilitation costs, home modifications), non-economic damages (pain and suffering, emotional distress, loss of enjoyment of life, disfigurement, loss of consortium), and potentially punitive damages in cases of egregious conduct.
Immediately after an accident, seek medical attention even if injuries seem minor, as some injuries may not be immediately apparent. Report the accident to police to ensure an official record exists. If possible, document the scene with photos and gather contact information from witnesses. Avoid discussing fault or giving statements to insurance companies before consulting with our attorneys, as early statements can be used against you later.
Yes, lane splitting is now legal in Arizona under specific conditions. The 2023 law allows motorcyclists to split lanes when the speed limit is 45 MPH or less, traffic is stopped, there are at least two lanes in the same direction, and it can be done safely. Riders must not exceed 15 MPH while lane splitting. This affects accident cases since lane splitting within these parameters is no longer automatically considered negligent behavior.
In Arizona, you generally have two years from the accident date to file a lawsuit. Exceptions exist for minors (clock starts at 18), later-discovered injuries, and claims against government entities (often just 180 days). Missing these deadlines typically means permanently losing your right to compensation, making prompt consultation with an attorney crucial.
Arizona follows “pure comparative negligence,” meaning multiple parties can share responsibility, with each assigned a percentage of fault. Your compensation is reduced by your percentage of fault, though you can recover damages even if 99% responsible. Insurance companies often try to unfairly assign higher fault percentages to motorcyclists, which our attorneys counter with strong evidence, expert testimony, and witness statements.
Arizona only requires helmets for riders under 18. While not wearing a helmet isn’t illegal for adults, it could potentially affect compensation if you suffered head injuries that a helmet might have prevented. However, helmet use has no relevance to accident liability, only potentially to head-injury damages, and the defense must prove your injuries would have been less severe with a helmet.
Don’t accept initial settlement offers without consulting an attorney. Don’t sign documents, provide recorded statements, or cash checks without understanding what rights you may be waiving. Early offers are typically far below your case’s actual worth, failing to account for future needs, pain and suffering, and the full extent of lost wages. Once accepted, you typically cannot seek additional compensation later, even if your condition worsens.
